1. PURPOSE OF THIS DOCUMENT

These General Terms and Conditions of Sale (hereinafter the “General Terms”) govern the sale to final consumers (hereinafter “Customers” or “Customer”) of women’s clothing and related accessories marketed by Woman Secret's (hereinafter “Woman Secret's”) through the dedicated area of the website https://womansecretshop.com (hereinafter the “Website”) in accordance with the procedures set out therein.

Sales of Products between Woman Secret's and Customers shall be governed by these General Terms. Products may be marketed through the Italian version of the website solely in Italy. For the purposes of these General Terms, “final consumer” means any natural person acting for purposes outside of their entrepreneurial, commercial, artisanal or professional activity, if any.

Products are marketed by Woman Secret's, headquartered in Naples, Via S. Alfonso Maria de Liguori, 3.

For any information regarding these General Terms and/or purchases made based on them, interested parties may complete the appropriate request form in the customer service area of the Website.

2. CONTRACT CONCLUSION PROCEDURE

The information and details contained in the e-commerce area of the Website must not be considered offers: they simply constitute an invitation to Customers to conclude transactions by submitting purchase proposals.

The purchase proposal for Products is submitted by Customers when they send the order form in electronic format, which Customers must complete and confirm on the order summary screen. If Customers wish to receive an invoice, they must select the appropriate option in the order form. Customers also have the option to indicate a shipping address different from the one provided when entering their personal details. Once the order form has been definitively submitted, an order summary page will be displayed and a confirmation email acknowledging receipt of the order will be sent.

By submitting the order form, the Customer agrees that any purchase contract shall be governed by these General Terms. Therefore, all orders are subject to acceptance by Woman Secret's, which reserves the right, at its sole and absolute discretion, not to accept any order proposal in the event that:

  • the data provided by the Customer when completing the order form is incomplete or incorrect;

  • the Customer does not qualify as a final consumer or does not meet the requirements to proceed with the payment terms;

  • the Products ordered are not available. To this end, Woman Secret's shall not be held responsible for changes in the availability of certain Products. If only some of the Products ordered are not available and there are no other grounds that may justify the non-acceptance of the order proposal, Woman Secret's will process the order proposal only for the available Products.

In the cases indicated above, Woman Secret's will inform the Customer by email that the order proposal has not been accepted (in whole or in part) and, therefore, the contract has not been concluded. In such a case, Woman Secret's will refund the Customer any sums already paid.

The purchase contract between the Customer and Woman Secret's shall be concluded only when the Customer's order is accepted by Woman Secret's. In such a case, Woman Secret's will send the Customer, at the email address provided by the Customer, confirmation that the purchase order is being processed.

3. PRICES AND PAYMENT TERMS

3.1. Product sales prices, shipping costs, and payment methods are those set out on the Website and are expressed in Euros. Product sales prices include VAT but do not include shipping costs, which will be added to the total amount due. Woman Secret's reserves the right to change the prices set out on the Website at any time. Under no circumstances may Woman Secret's be held responsible for any price changes.

3.2. The Customer agrees to pay the price of the Products purchased in the following ways:

  • Online credit card: payment by Visa, Mastercard, or Maestro credit card. Credit card payments are processed directly by Shopify Payments, which ensures the security of online transactions through the use of 128-bit SSL encryption protocols. For this reason, Woman Secret's does not receive any information relating to the Customer's credit card. Once the order has been received, Woman Secret's will request a pre-authorization on the Customer's credit card to ensure that the Customer has sufficient funds to complete the transaction. Credit cards will be subject to checks and authorizations by the card issuer. Woman Secret's shall not be responsible for any failure by the issuer to grant such authorizations. Once the contract is concluded pursuant to Article 2 above, the charge to the credit card will be final;

  • PayPal: in this case, the charge will be made upon confirmation of receipt of the order. If Woman Secret's does not accept the order proposal, the amount will be credited back to the Customer.

  • Klarna: payment via Klarna allows the payment to be spread over 3 (three) interest-free installments, which will be automatically deducted from the Customer's credit card. The first payment will be deducted when the order is shipped from the warehouse, the second 30 (thirty) days after the shipping date, and the third 60 (sixty) days after the shipping date. The terms and conditions of payment via Klarna are available at the following link http://www.klarna.com. It is understood that Woman Secret's shall not be responsible for Klarna's possible refusal to accept this payment method, nor for any dispute between the Customer and Klarna.

  • Gift card: the amount due from the Customer will be deducted from the amount loaded on the Gift Card upon confirmation of receipt of the order. If Woman Secret's does not accept the order proposal, the amount will be reloaded onto the Gift Card. Gift Card payments are processed by Shopify Payments.

  • Cash on delivery: payment will be made in cash upon delivery directly to the courier. The courier does not provide change. Maximum allowed order: €499.

4. PRODUCT SHIPPING METHODS

4.1. Products will be delivered according to the times and methods set out in the delivery service selected by the Customer from the various options listed on the Website. Shipping costs for home delivery are borne by the Customer and may vary depending on the delivery service selected. Once shipped, Woman Secret's will send the Customer an email notification of shipment with instructions on how to track the shipment. In the event of shipping delays due to causes beyond Woman Secret's control, the Customer will be promptly notified by Woman Secret's customer service. Shipments are made only within Italian territory.

4.2. The risks associated with the Products pass to the Customer upon delivery of the Products to the Customer or to a third party designated by the Customer. The risk passes to the Customer upon delivery to the carrier if the carrier was selected by the Customer and such selection was not proposed by Woman Secret's.

5. RIGHT OF WITHDRAWAL

5.1. The Customer has the right to withdraw without any penalty and without stating a reason within 14 calendar days from the day of receipt of the Products purchased under these General Terms.

5.2. The right of withdrawal may be exercised, within the period referred to in Article 5.1 above, by sending Woman Secret's an express declaration of the Customer's intention to withdraw.

5.3. To simplify the exercise of the right of withdrawal, Woman Secret's makes an appropriate return procedure available to the Customer on the Website, which can be easily initiated from the “My Orders” page within the Customer's personal profile (“Account”) under “Returns and Refunds” or, for unregistered Users, via the “Track Your Order” section. In such a case, Woman Secret's will provide the Customer with confirmation of the exercise of the right of withdrawal.

5.4. It is an essential condition for the Customer to exercise the right of withdrawal that the integrity of the Products to be returned is preserved. In particular, the Products must not have been used, worn, washed, or damaged; the identification tag must still be attached to the Products with the single-use seal, as must the various composition and washing labels.

5.5. The Customer must exercise the right of return within 14 calendar days from the date of receipt of the Products. The Customer may choose to return the Products directly to a Woman Secret's store or return them by courier. The Products must be returned within 14 days of the Customer notifying Woman Secret's of their intention to withdraw. In the case of return by courier, the returned Products must be sent to Woman Secret's in a single shipment. The Products must be returned using the same shipping packaging. Details on how to make a return can be found on the Website in the “Returns and Refunds” section and within the “Frequently Asked Questions”.

5.6. Woman Secret's will issue the refund as quickly as possible and in any event within 30 (thirty) days from the date it becomes aware of the Customer's exercise of the right of withdrawal, following verification that all requirements necessary for the exercise of the right of withdrawal have been met.

5.7. The refund will be issued by Woman Secret's using the payment method used by the Customer at the time of the online purchase. Consequently, if payment was made using points accumulated with the Fidelity Card or another promotion, converted into discount vouchers, the refund will be issued by crediting the aforementioned points / discount vouchers. It is understood that if purchases were made partly using discount vouchers and partly using another payment method, the refund will be issued using each type of payment previously used by the Customer.

6. TIMES AND METHODS FOR REFUNDING RETURNED PRODUCTS

6.1. If the right of withdrawal was exercised within the terms and conditions set out in Article 5 above and the checks on the Products returned pursuant to the withdrawal have been concluded successfully, Woman Secret's will send the Customer, by email, the relevant confirmation of acceptance of the returned Products.

6.2. Consequently, Woman Secret's will refund the sums paid by the Customer for the purchase, including delivery costs in the case of a full return, net of any discounts and/or promotions.

The Customer shall only be responsible for any reduction in the value of the Products resulting from handling other than that necessary to assess their characteristics. The return shipment is at the Customer's expense, and the Customer may choose the courier to use. Once the return has been received, Woman Secret's will process the refund within 2-4 business days. If all items in the order are returned, the cost of the items (net of any discounts) will be refunded, while in the case of a partial return, the cost of the returned items net of any discounts will be refunded.

7. PRODUCTS

7.1. The Products illustrated on the Website are original products of the “Woman Secret's” brand. The characteristics of each Product are set out on the Website within each product page; however, the colors of the Product may not correspond to the actual colors due to the internet browser and monitor used.

7.2. The Products are guaranteed against any conformity defects existing at the time of delivery, as provided for by Articles 130 and 132 of the Consumer Code.

8. PROTECTION OF PERSONAL DATA

Regarding all obligations relating to the collection and processing of the Customer's personal data and the related purposes, reference is made to the specific notice contained on the Website.

9. APPLICABLE LAW AND DISPUTE RESOLUTION

The General Terms and Conditions of Sale are governed by Italian law, in particular by Legislative Decree No. 206 of 6 September 2005 (Consumer Code), with specific reference to the regulations on distance contracts, as amended by Legislative Decree No. 21 of 21 February 2014 and Legislative Decree No. 70 of 9 April 2003 on certain aspects concerning electronic commerce. For any dispute relating to the validity, interpretation, or performance of these General Terms and Conditions of Sale, the court of the Customer's place of residence or domicile shall have jurisdiction.
